These General Terms and Conditions apply to purchases made through TudorDarkness, including hand-painted 3D art, figurines, dioramas, decorative pieces, paintings, custom-made products and other artwork offered through our website.
By placing an order with TudorDarkness, the customer agrees to these General Terms and Conditions.
1. About Our Products
TudorDarkness creates hand-painted 3D art, figurines, dioramas, collectibles, paintings and custom-made artwork.
Many of our products are individually 3D printed, assembled, prepared and painted by hand. Because of this handmade process, minor variations in colour, brushwork, texture, surface finish and other details are normal and form part of the individual character of the artwork.
Photographs on our website are intended to represent our products as accurately as reasonably possible. Colours may appear slightly different depending on lighting, photography and screen settings.
2. Orders
An order becomes binding once the customer has completed the ordering process and TudorDarkness has accepted or confirmed the order.
Customers are responsible for providing accurate billing, shipping and contact information.
TudorDarkness reserves the right to refuse or cancel an order where there is a legitimate reason to do so, including obvious pricing errors, inability to produce the requested product or suspected fraudulent activity. Where an order is cancelled by TudorDarkness and payment has already been received, the relevant amount will be refunded.
3. Prices and Payment
Prices are displayed on the website in the applicable currency and include or exclude taxes as indicated during checkout and as required by law.
Any applicable delivery costs or other charges will be displayed before the customer completes the order.
Orders must be paid using one of the payment methods offered through the website.
4. Handmade and 3D-Printed Products
Customers acknowledge that handmade and 3D-printed products may contain small characteristics resulting from the manufacturing and painting process.
These may include subtle layer lines, small surface variations, minor differences in colour or brushwork and slight differences compared with photographs of another example of the same design.
Such characteristics are not automatically considered defects where they are inherent to the handmade or 3D-printing process and do not materially affect the quality, appearance or intended use of the product.
This provision does not limit the customer's statutory rights regarding defective or non-conforming goods.
5. Custom Orders
A Custom Order is a product specifically created, modified or personalised according to the customer's individual specifications.
This may include, for example, individually requested dimensions, colours, characters, designs, inscriptions, compositions or other personalised features.
Before production begins, the customer is responsible for checking and approving the agreed specifications.
Once production of a personalised Custom Order has begun, changes may not always be possible. Additional work requested after approval may result in additional charges.
6. Returns — Standard Products
Consumers purchasing standard, non-personalised products online generally have a statutory 14-day right of withdrawal, subject to the exceptions provided by applicable law.
Where the statutory right of withdrawal applies, customers must notify TudorDarkness within the applicable legal period.
Unless otherwise required by law, the customer is responsible for the direct cost of returning a product when this has been clearly communicated before purchase.
Products must be returned with reasonable care. The customer may be responsible for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the product.
Nothing in this section affects statutory warranty rights concerning defective or incorrectly supplied products.
7. Custom and Personalised Orders — No Right of Withdrawal
Products made according to the customer's specifications or clearly personalised are excluded from the statutory 14-day right of withdrawal where the legal requirements for that exception are satisfied.
Therefore, Custom Orders cannot normally be returned or cancelled simply because the customer changes their mind.
Once a personalised Custom Order has entered production, payments are non-refundable to the extent permitted by applicable law.
This does not affect the customer's statutory rights if a custom product is defective, damaged, incorrectly produced or otherwise does not conform to the agreement.
8. Cancellations
Customers should contact TudorDarkness as quickly as possible if they wish to cancel an order.
For standard products, statutory cancellation and withdrawal rights apply where required by law.
Custom Orders that have already entered production cannot normally be cancelled where the statutory personalised-goods exception applies.
9. Shipping and Delivery
TudorDarkness will take reasonable care when packaging products for shipment, particularly fragile figurines, dioramas and artwork.
Estimated delivery dates are estimates unless a specific delivery date has expressly been agreed.
TudorDarkness is responsible for the shipment in accordance with applicable consumer law until the goods have been received by the customer, except in circumstances where the law places the transportation risk on the customer.
For example, different rules may apply where a customer independently chooses a carrier that was not offered by TudorDarkness.
10. Products Damaged During Shipping
Customers should inspect their order as soon as reasonably possible after delivery.
If an item arrives damaged, customers should contact TudorDarkness promptly and provide:
- photographs of the damaged product and packaging;
- the order number;
- a description of the damage; and
- any other information reasonably required to investigate the shipment.
Customers should retain the original packaging while the matter is being investigated.
Where TudorDarkness is legally responsible for damage occurring during delivery, we will provide an appropriate remedy in accordance with applicable consumer law.
11. Legal Guarantee and Defective Products
All statutory consumer guarantees remain applicable.
Products must conform to the purchase agreement and possess the qualities that a customer may reasonably expect from them.
Where a product is legally considered defective or non-conforming, the customer may be entitled to repair, replacement, price reduction or reimbursement depending upon the circumstances and applicable law. Dutch sellers cannot exclude this statutory guarantee through their General Terms and Conditions.
12. Care and Use
Our figurines, dioramas and decorative artworks are intended primarily as display and collectible pieces unless expressly stated otherwise.
Customers should handle delicate components carefully and keep products away from excessive heat, moisture, prolonged direct sunlight and other conditions that could damage PLA, paint, protective coatings or decorative materials.
TudorDarkness is not responsible for damage caused after delivery through misuse, accidents, improper storage, modification, negligent handling, ordinary wear and tear or failure to follow provided care instructions, except where applicable law provides otherwise.
13. Intellectual Property
Unless stated otherwise, photographs, original designs, website graphics, written material, branding and original artwork created by TudorDarkness remain the intellectual property of TudorDarkness or their respective rights holders.
Purchasing a physical product does not transfer intellectual-property rights in the underlying design or artwork.
Nothing in these Terms grants permission to reproduce TudorDarkness original artwork, photography or branding for commercial purposes without prior permission.
Third-party characters, trademarks and other intellectual property remain the property of their respective rights holders.
14. Liability
TudorDarkness will not be liable for indirect or consequential losses to the extent that such liability may lawfully be excluded.
Nothing in these General Terms and Conditions excludes or restricts liability where doing so would be prohibited by applicable law.
In particular, these Terms do not exclude statutory consumer rights or liability that cannot legally be excluded or limited.
Dutch guidance specifically warns businesses that they cannot simply exclude all liability in their terms.
15. Force Majeure
TudorDarkness will not be responsible for a failure or delay in performing obligations where performance is prevented by circumstances beyond our reasonable control, to the extent permitted by law.
Such circumstances may include natural disasters, serious transportation disruption, war, government restrictions, major infrastructure failures or other exceptional events outside our control.
Any mandatory rights available to consumers remain unaffected.
16. Complaints
If a customer has a problem with an order, they should contact TudorDarkness so that we have an opportunity to investigate and resolve the matter.
Customers should provide their order number and a clear description of the issue and, where relevant, photographs.
We will endeavour to respond within a reasonable period.
17. Governing Law
These General Terms and Conditions and agreements concluded with TudorDarkness are governed by Dutch law, unless mandatory consumer-protection legislation requires otherwise.
Nothing in this provision deprives a consumer of mandatory protections granted by the law that is applicable to them.
18. Changes to These Terms
TudorDarkness may amend these General Terms and Conditions from time to time.
The version applicable to an order is generally the version made available to the customer when the agreement was concluded.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

20. Made especially for you
Our 3D artworks are individually printed, prepared and hand painted after your order is placed. Where a product is created according to your individual specifications or personalised at your request, it is considered a custom-made product and the statutory right of withdrawal does not apply, as permitted under Dutch and EU consumer law. Your statutory rights regarding defective or non-conforming products remain unaffected.
